In Hindu law, an alienee is a person who acquires property from the Karta of a joint Hindu family.
The term “alienee” refers to a person who receives property from the Karta through a legal transfer, such as a sale, gift, mortgage, lease, or exchange.
The alienee becomes the owner of the property and has the right to enjoy, use, and dispose of the property as per his/her wishes, subject to certain limitations imposed by the law.
If the transaction is challenged by a coparcener or any other person, the alienee has certain rights and remedies available under Hindu law.
Alienee’s Rights
- Right to enjoy the property: Once the property is legally transferred to the alienee, he/she has the right to enjoy the property and use it as per his/her wishes.
- Right to transfer the property: The alienee has the right to transfer the property to any other person, subject to the limitations imposed by the law.
- Right to challenge improper challenge by coparcener: If a coparcener challenges the alienation of the property by the Karta, the alienee has the right to defend his/her rights in court.
- Right to seek compensation: If the court declares the transaction null and void, the alienee may have the right to seek compensation from the Karta for any loss or injury suffered as a result of the improper alienation.
- Right to seek remedy under specific laws: The alienee may also have the right to seek remedy under specific laws like the Transfer of Property Act, 1882, and the Hindu Succession Act, 1956, if the transaction is challenged by a coparcener or any other person.
Alienee’s Remedies
- Recovery of money or property from Karta: If the court declares the transaction null and void, the alienee may have a right to recover his or her money or property from the Karta.
- Claim for damages against Karta: The alienee may also have the right to claim damages from the Karta for any loss or injury suffered as a result of the improper alienation.
- Specific Performance: If the Karta breaches the terms of the contract of alienation, the alienee may seek specific performance of the contract.
- Injunction: If the Karta threatens to alienate or dispose of the property, the alienee may seek an injunction from the court to restrain him from doing so.
- Possession of property: If the Karta wrongfully dispossesses the alienee of the property, the alienee may seek a decree for possession from the court.
- Right to sue coparcener: If a coparcener challenges the alienation of the property by the Karta, the alienee has the right to defend his/her rights in court, and sue the coparcener for any losses suffered.
