The Effects of Adoption under Hindu Law
- Severance of ties with biological family: Once a child is adopted, they are considered to be the child of the adoptive parents, and all ties with the biological family are severed. The adopted child is given the same status, rights, and obligations as a biological child.
- Succession rights: The adopted child acquires the right to inherit the property of the adoptive family as if they were the biological child of the adoptive parents. However, they do not have any right to the property of their biological family.
- Cessation of rights and obligations: The biological parents lose all their parental rights and obligations towards the adopted child, and the adopted child ceases to have any rights and obligations towards the biological family.
- Rights of adoptive parents: The adoptive parents have the same rights and obligations towards the adopted child as they would have towards a biological child. They have the right to provide for the maintenance, education, and upbringing of the adopted child, and they are responsible for their welfare.
- Name and status: Once a child is adopted, their name is changed to reflect their new family. They are also given the same status in society as a biological child of the adoptive parents.
