The Land Acquisition Act, 1894 provides for penalties for various offences committed under the Act.
Important Penalties under the Act
- Obstructing Acquisition: Any person who obstructs the government from acquiring land or fails to comply with any lawful order of the government is punishable with imprisonment for a term that may extend up to six months or a fine, or both.
- False Statements: Any person who knowingly makes a false statement or gives false information in any declaration, statement, or evidence under the Act is punishable with imprisonment for a term that may extend up to two years or a fine, or both.
- Refusing to Give Possession: Any person who refuses to give possession of the land to the government after the compensation has been paid is punishable with imprisonment for a term that may extend up to three years or a fine, or both.
- Failure to Make Deposit: Any person who fails to make a deposit or provide security for the compensation awarded by the Collector is punishable with imprisonment for a term that may extend up to six months or a fine, or both.
- Trespassing: Any person who enters the land after the government has taken possession of it is punishable with imprisonment for a term that may extend up to three years or a fine, or both.
